Since the U.S. Court of Appeals for the Federal Circuit decision in State Street Bank & Trust Co. v. Signature Financial Group, Inc., 149 F.3d 1368 (Fed. Cir. 1998), in 1998, the public debate has been on going over what type of patent protection should be available for Software-related and Business-related Inventions.

In the U.S. a rather expansive view of what can and should be patent-eligible subject matter is generally held. On the other hand, in Europe a more restrictive view of what can and should be patent-eligible subject matter has been adopted, and frequently challenged.
